GENERAL CONDITIONS - SALON LOOK 2022 BEARDBURYS PROMOTION
1.- Organising companies and general terms and conditions
Carobels Cosmetics, S.L, (hereinafter, "Beardburys") with registered office at Avenida Antibióticos, Nº73, León, 24009 and identified with the number B24068256, Fiscal Identifier will carry out a nationwide promotion (Spain). The Promotion will be governed by these legal bases (hereinafter, the "Legal Bases"). Express acceptance of these Legal Bases is a necessary condition for participation in the Promotion and, consequently, to be able to obtain the prizes. It shall be understood that all participants in the Promotion, by the simple fact of their participation in the same, accept the Legal Bases in their entirety and the rules that govern their procedure.
2.- Territorial scope of the Promotion
The Promotion will take place in the national territory of Spain.
3.- Duration of the Promotion
The Promotion will run from Saturday 21 October 2022 until Saturday 31 December 2022.
The Promotion will be settled at the same time as the gifts are handed out during the Fair from 21 to 23 October 2022.
The Promotion will run from 21 October 2022 at 10:00 am until Saturday 31 December 2022 at 12:00 am. Except for the Direct Prizes which will be from 21 to 23 October 2022 (hereinafter, the "Promotional Period").
4.- Persons entitled to take part in the Promotion
Anyone attending the Salon Look 2022 Fair can participate in the same, free of charge and voluntarily.
The mode of participation will be according to the mechanics set out in this document. Participation in the Promotion is forbidden to all persons professionally linked to Beardburys, including their first-degree relatives.
5.- Mechanics of the Promotion:
The Promotion will be announced and will take place during the Salon Look 2022 Event at IFEMA Madrid. To participate in this Promotion, the user will have to do the following during the Promotional Period:
1. Come and visit us at our Stand 14E07A- 14E07B during the 21st, 22nd and 23rd of October 2022.
2. Tell us that you want to participate in the promotion, you will only have to show us your accreditation for us to read it and we will randomly give you a can of styling wax that will contain a prize inside. Only one entry per accreditation will be accepted.
Participation in this Promotion is completely free of charge. The organisers reserve the right to disqualify those participations whose content or behaviour they consider inappropriate, offensive, insulting or discriminatory and/or that could violate the rights of third parties.
6.- Winners and awards:
This Promotion will have a total of one thousand (1000) prizes available at Stand 14E07A at Salon Look 2022. In order to benefit from the promotion, all the requirements specified in these legal bases must have been fulfilled.
The set of prizes consists of:
- Six hundred and fifty three (653) 10% discount coupons. Redeemable more than once.
- Ninety (90) 20% discount coupons with a minimum purchase order of €25.
- Six (6) Beardburys & Gas Monkey Kits (winner's choice). Direct prize, i.e. will be awarded on the spot*.
- Fifty (50) Gift Fix products with a minimum order value of £25.
- Six (6) 40% vouchers with a minimum order value of €25.
- Forty (40) 10% coupons plus a free gift of one Product (100ml) from the Treatment or Hold line depending on availability with a minimum purchase order of £25.
- Seventy (70) complimentary 100ml Waxes with a minimum order value of €25.
- One (1) Fade Boost machine as a gift. Direct prize, i.e. it will be given at the same time*.
- Eighty-three (83) Gift Treatment Products with a minimum order value of £25.
- One (1) Skid Zero Gift machine. Direct prize, i.e. to be awarded on the spot*.
*To benefit from the direct prizes, it will be necessary to claim them at our stand 14E07A - 14E07B within the period from 21 to 23 October 2022.
7.- Publication of the winners
Prizes will be known at the moment the person receives the gift.
The direct prizes will be given at the moment as long as the person claims the prize at that moment. Direct prizes can only be claimed during the duration of the Fair at our stand 14E07A -14E07B from 21st to 23rd October 2022.
8.- Delivery of the prizes:
To benefit from the prizes, the winner will have to redeem the prize on the website www.beardburys.com when placing an order, which will be active until 31 December.
To benefit from the direct prizes, the winner will have to request it at our stand 14E07A - 14E07B during the duration of the Fair, i.e. from 21 to 23 October 2022.
Participants are responsible for the contact details they provide and for checking the messages sent to their email addresses.
In the event that the winner does not accept the prize in accordance with the established conditions, or does not fulfil the requirements described in these rules, it will be understood that he/she refuses the prize and the prize will be passed on to the substitute, who will follow the same procedure as the winner. In the event that the substitute does not accept the prize either, or does not meet the requirements described in these rules, it will be understood that he/she refuses the prize and, therefore, the prize will not be awarded.
9.- Limitations:
9.1. The prizes object of this Promotion, in no case may be subject to change, alteration or compensation at the request of any of the winners. Likewise, the sale or commercialisation of the prize is also prohibited.
9.2. The prizes are strictly personal and may not be transferred, collected, reimbursed in part or in full or exchanged for other articles or services.
9.3. The waiver of any of the prizes by any winner will not give any right of indemnity or compensation.
9.4. Beardburys is not responsible for possible claims related to the enjoyment of the prize, nor for the possible expectations that may be had about it.
9.5. This Promotion is limited to a specific number of participations and is limited to one prize per person.
10.- Reservas:
10.1. Beardburys is not responsible for the participation of fraudulent actions and/or actions that attempt to impersonate its identity by publishing the same Promotion and demanding information from the user participating in the official accounts.
10.2. Beardburys will not assume any responsibility derived from damages and/or prejudices of any nature that the participants of the present Promotion and/or a third party may suffer, and which are derived from the lack of availability, maintenance, reliability or effective functioning of the web pages linked to the Promotion for reasons attributable to third parties. In this sense, Beardburys excludes, to the maximum extent permitted by current legislation, any liability that may arise from damages of any nature that the user and/or a third party may suffer, which are derived from the lack of availability, continuity or malfunctioning of the websites linked to the Promotion, and which may affect or prevent participation in the present Promotion, its normal development or the correct transmission of the contents.
10.3. In general, Beardburys will not assume any responsibility for any damage, loss or liability that any participant or third party external to the Promotion may suffer and that derives, directly or indirectly, from participation in the Promotion.
10.4. If Beardburys has reasonable grounds to believe that an entrant has breached any of the terms and conditions set out in these Terms and Conditions or considers an entry to be abusive or fraudulent, it reserves the right to exclude that entrant from the Promotion.
10.5. In the event that Beardburys detects any type of anomaly, or suspects that a participant is impeding the normal functioning or development of the Promotion, either by unlawfully altering their registration and participation, falsifying their participation, using unauthorised information by means of any technical or computer procedure, or carrying out a use of the contents made available that is inappropriate, unlawful or contrary to the regulations in force and/or these Legal Bases, it reserves the right to unilaterally eliminate the registration and participation of said user in the Promotion, as well as to pursue said conduct, with all the means that the Legal System places at its disposal.
10.6. If a Participant indicates incorrect, incomplete or false data, he/she will be excluded from the Promotion and his/her participation will be considered null and void.
10.7. Beardburys reserves the right to make changes at any time in order to ensure the success of the Promotion. In this case, Beardburys will publish such changes for the knowledge of all participants.
10.8. Beardburys reserves the right to cancel, suspend and/or modify the Promotion, in whole or in part, in the event of fraud, technical failure, or any other factor beyond Beardburys' reasonable control that prevents the integrity or proper functioning of the Promotion, in Beardburys' sole discretion. In no event shall Beardburys be held liable as long as the circumstances warrant.
11.- Privacy and data protection policy
11.1 Beardburys is the data controller. The data requested will be the following:
- Data provided to Salon Look for access to the venue by means of accreditation: Full name and surname, e-mail, contact telephone number, etc. Beardburys reserves the right to ask the winners for a copy of their National Identity Card or equivalent valid identification document in order to check that they have complied with the participation requirements.
11.2 The winner and the participants in this promotion expressly authorise Beardburys to reproduce, use and disseminate their name, surname, image and any other information provided in any advertising and/or promotional activity related to this Promotion, in any medium, including the internet, and to post photos of the winner on the website, without these activities conferring any right to remuneration or benefit whatsoever, with the exception of the delivery of the prize won in accordance with these rules. The participant transfers to Beardburys, without limitation, all the rights to the images that may correspond to him/her as a result of his/her participation and contribution to the competition, and in particular, the exploitation rights (reproduction, distribution, public communication and transformation). The assignment of the aforementioned rights is carried out, in any modality, and during the legal term of duration of said rights and for the worldwide scope, authorising their exploitation in any modality, support, format, and through any technical procedure. For the purposes of the provisions of current legislation, the participant grants Beardburys express authorisation to use, in accordance with the usual uses on the Internet, the data, photographs, images and other works provided, as well as, in general, any other information relating to the same that may be considered convenient or necessary for the creation or commercial exploitation. In any case, the transfer of the aforementioned rights shall be free of charge.
11.3. The personal data will be registered in a commercial database for the purpose of managing this competition and sending out information on a regular basis. In compliance with the provisions of Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights and EU Regulation 2016/679, the user is informed that all data provided will be incorporated into a file, created and maintained under the responsibility of Beardburys. The confidentiality of your personal data will always be respected and will only be used for the purpose of managing the services offered, responding to your requests, carrying out administrative tasks, as well as sending technical, commercial or advertising information by ordinary or electronic means. Participants authorise Beardburys to use their name, surname, image and photographs to publicly announce the results of the promotion and competition and the identity of the winner, disseminating them to the general public through the internet and any other global media of an open nature, without this giving rise to any right to any compensation whatsoever. This authorisation is valid worldwide and is valid for a period of five years from the date of the Promotion and competition. Beardburys shall not be liable for residual acts of communication after this date as a result of copies made by third parties during the period of validity of the authorisation.
12.- Acceptance of the terms and conditions
Participants, by the mere fact of participating in the corresponding promotion, accept the present terms and conditions, as well as Beardburys' criteria for resolving any incident that may arise.
13.- Disagreement
In the event of any dispute, claim or controversy, claims must be addressed within the legal period and in writing to the address given in the heading of these terms and conditions, who, in accordance with the legislation in force, will channel the claim to the corresponding agent, if applicable. Each participant undertakes, in the event of any difficulties that may arise regarding the application or interpretation of the Rules, and before taking any contentious action, to try to reach an amicable solution with Beardburys. These Terms and Conditions are subject to Spanish law.
